Terms of Service
Effective: August 13, 2026
These Terms form an agreement between you and Xemivo Ltd., located at 70 Songdo-gwahak-ro, Yeonsu-gu, Incheon, Republic of Korea, for access to XEMIVO VIN websites, vehicle-data services, reports, workspaces, APIs and related features.
Eligibility and acceptance
You must have legal capacity to enter this agreement. If you use XEMIVO for a company, you confirm that you are authorized to bind that company. By creating an account, purchasing access or using the service, you accept these Terms and the Privacy Policy.
Accounts and security
You must provide accurate information, keep credentials confidential and promptly notify us of suspected unauthorized access. Workspace owners are responsible for members, roles, permissions and activity within their workspace.
Vehicle information and reports
Vehicle information is obtained from connected providers and may vary by VIN, manufacturer, model year, country and source coverage. XEMIVO organizes available evidence but does not guarantee that a report is complete, current or error-free. Unavailable information must not be interpreted as confirmation that no accident, damage, title, mileage, recall, repair or ownership event exists.
Decision disclaimer
XEMIVO is an information and workflow service, not a substitute for physical inspection, manufacturer confirmation, government records, professional valuation, legal advice, customs advice, tax advice or safety checks. You remain responsible for purchase, sale, import, finance and operational decisions.
Plans, credits and payment
Prices, taxes, included credits, renewal terms and plan features are shown before checkout. A successful VIN request may consume a credit. Subscription access continues for the purchased period unless cancelled or otherwise required by law. Payment services may be provided by third-party payment processors under their own terms.
Vehicle import services
Xemivo Ltd. operates the digital platform, coordinates import requests and provides vehicle-intelligence services. South Korea vehicle sourcing, purchase, export, shipping coordination and import services are fulfilled through Xtreme Motors Ltd.. Equivalent operations originating in Germany are fulfilled through Xtreme Motors GmbH. Both are group companies. Before any vehicle transaction, the responsible contracting entity, service scope, price, payment terms, route and applicable conditions will be identified in the relevant quotation, invoice or agreement. Digital-report purchases remain separate from vehicle-purchase and import contracts.
Acceptable use
You may not use XEMIVO unlawfully; access another user’s data; bypass access, credit or rate limits; scrape or resell data without written authorization; probe security; upload malicious or infringing material; misuse provider information; or interfere with the platform. API use is also subject to documented scopes, limits and credentials.
Your content and business records
You retain responsibility for information and documents you submit. You grant us the limited right to host and process that material only as needed to operate, secure and improve the service. You must have authority to submit personal, customer, vehicle and company information.
Intellectual property
XEMIVO software, design, branding, reports, normalization methods and documentation are owned by or licensed to Xemivo Ltd. Except for the limited right to use the service under these Terms, no intellectual-property rights are transferred to you.
Availability, changes and suspension
Provider coverage and platform features may change. We may maintain, restrict or suspend access when reasonably necessary for security, legal compliance, payment failure, abuse or provider protection. We will give reasonable notice of material service changes where practicable or legally required.
Liability
To the maximum extent permitted by law, Xemivo Ltd. is not liable for indirect, incidental, special or consequential loss, lost profit, lost opportunity or a transaction decision based solely on incomplete provider data. Any limitation does not apply where liability cannot legally be excluded, including liability arising from fraud, wilful misconduct, gross negligence or mandatory consumer-protection law.
Termination
You may stop using the service and cancel eligible subscriptions through the available account or support process. We may terminate or suspend access for material breach, unlawful conduct, security risk or non-payment. Provisions intended to survive termination—including payment, intellectual property, disclaimers and dispute terms—remain effective.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules. Subject to any mandatory consumer venue rights, disputes shall be submitted to the competent courts having jurisdiction in Incheon, Republic of Korea. Nothing in these Terms removes consumer rights that cannot be waived under the law of the user’s habitual residence.
